    A number of model clauses which may be used to site a mediation or arbitration in TAG-RESOLUTION are set out below. Legal advice should, however, be sought on the choice of suitable clause and applicable law:

    • Mediation clause
      “Any dispute or difference arising out of or in connection wit h the contract shall first be referred to mediation at Talal Abu Ghazaleh Dispute Resolution Center and in accordance with its Mediation Rules. If the mediation is abounded by the mediator or is otherwise concluded without the dispute or difference being resolved, then such dispute or difference shall be referred to and determined by arbitration at Talal Abu Ghazaleh Dispute Resolution Center and in accordance with its Arbitration Rules.”
    • Arbitration clause for Future Disputes
      “Any dispute arising out or in connection with this contract, including any question regarding its existence, validity or termination, shall be referred to and finally resolved by arbitration under the TAG-Resolution Arbitration Rules, which Rules are deemed to be incorporated by reference into this clause

      • The number of arbitrators shall be (one/ three)
      • The place of arbitration shall be (City and/ or Country)
      • The language to be used in the arbitral proceedings shall be (…)
      • The governing law of the contract shall be the substantive law of (…)”
    • Arbitration clause for exciting Disputes
      “A dispute having arisen between the parties concerning (…), the parties hereby agree that the dispute shall be referred to and finally resolved by arbitration under TAG-Resolution Arbitration Rules.

      • The number of arbitrators shall be (one/ three)
      • The place of arbitration shall be (City and/ or Country)
      • The language to be used in the arbitral proceedings shall be (…)
      • The governing law of the contract shall be the substantive law of (…)”

    Other Arbitration Clauses for International Arbitration:

    • Arbitration under the ICC Rules of Arbitration.
      ICC Model Clause
      “All disputes arising out of or in connection with the present contract shall be finally settled under the Rules of Arbitration of the International Chamber of Commerce by one or more arbitrators appointed in accordance with the said Rules.”

    • Arbitration under the International Arbitration Rules of the American Arbitration Association
      UNICITRAL Model Clause
      For parties adopting the UNCITRAL Arbitration Rules, we recommend that they adopt the following:

      • “Any dispute, controversy or claim arising out of or relating to this contract, or the breach, termination or invalidity thereof, shall be settled by arbitration in _____(Country)_____ in accordance with the UNCITRAL Arbitration Rules as at present in force.
      • The arbitration shall be administered by Talal Abu Ghazaleh Dispute Resolution Centre (TAG-Resolution) in accordance with its practice rules.
      • The appointing authority shall be the Chairman or Director of the Center.

  • Arbitrators & Experts

    TAG-Resolution keeps a list of qualified arbitrators & mediators, who can be appointed by parties to serve as arbitrators or Mediators. The center may also select such arbitrators from the list if no agreement has been reached between the parties.

    Established arbitrators or Mediators may apply (rmul@gztivhlofgrlm.lit) to be accepted in TAG-Resolution list of Arbitrators or Mediators. In order to maintain highly qualified arbitrators or mediators, this elite group of professionals with extensive experience in the field of Alternative Dispute Resolution is carefully selected from the numerous applications we receive.

    If you are qualified according to our Standards, you will be accepted as a TAG-Resolution listed arbitrator or Mediators.

  • Membership

    • Qualifications for membership
      All professionals from all nationalities and levels of experience in Dispute Resolution are welcome. This means attorneys, international arbitrators or mediators, engineers, accountants, businessmen, representatives of commercial and trading organisations and experts in all fields.
    • Memberships Fees
      TAG-RESOLUTION Membership dues are 120 JD per individual, per year beginning on the 1st January to 31st December.
      This equates to 10 JD per month.

    As a registered associate member of TAG-RESOLUTION, you will enjoy a wide range of advantages and opportunities. The membership period is from January to December each year. The subscription for members who join part-way through the year is calculated on a pro-rata basis.

    TAG-RESOLUTION offers exclusive educational workshops and professional development courses to its members; attending international conferences on the latest issues in Alternative Dispute Resolution ADR and establishing and maintaining contacts with both national and international networks of professionals.
